TERMS & CONDITIONS of Business

Living CBT is a division of the Publisher (Manchester Cognitive Behaviour Therapy Ltd.)

1. GENERAL
(a) All orders are accepted and goods supplied to the following express terms and conditions and all other conditions, warranties and representations, express or implied and statutory or otherwise, are hereby excluded.

No addition thereto or variation therefrom or waiver thereof shall be binding unless agreed in writing by the authorised representative or Living CBT/MCCBT Ltd.

2. CUSTOMER ORDER CONDITIONS
(a) Any provisions of the customer's order which conflicts with, or are in addition to, the general terms of business for Living CBT/MCCBT Ltd. or any special terms of business shall be excluded.

(b) Should any of the present terms and conditions of business be inapplicable this would not imply that the rest of the present terms do not remain valid.

3. DESPATCH DATES
(a) Any times quoted for despatch are to be treated as estimates only. Whilst every endeavor will be made to meet these estimated times for despatch. Living CBT/MCCBT Ltd. shall not be liable in any manner whatsoever for failure to despatch within the time quoted. In case of delays caused by circumstances beyond the control of Living CBT/MCCBT Ltd. or its suppliers, Living CBT/MCCBT Ltd. shall have the right either to:

(i) suspend deliveries without notice, or
(ii) cancel the contract without liability.

(b) By way of illustration and not limitation, the following are to be regarded as uncontrollable events: strike, lockout, riot, revolution, mobilisation, war, epidemic, official regulations, transportation difficulties, working difficulties, machinery breakdown, fire, failure of suppliers, or other causes, whether similar or not.

4. COPYRIGHT AND OWNERSHIP
Unless otherwise stated:
Living CBT/MCCBT Ltd. retains full copyright in all works originated by it, subject to the above.

5. CONSEQUENTIAL LOSS OR DAMAGE
Living CBT/MCCBT Ltd. shall not be liable for any loss or damage or claim whatsoever nature of to whomsoever caused by the use of goods, designs and printed materials supplied by it. The customer shall also indemnify Living CBT/MCCBT Ltd. against all claims made against Living CBT/MCCBT Ltd. by any third part in respect thereof.

6. COMPLAINTS & RETURNS PROCEDURE
In case of any complaint concerning the delivery or quality of the products supplied by Living CBT/MCCBT Ltd., the customer should notify Living CBT/MCCBT Ltd. in writing within 7 days of delivery.

7. LIMITATION OF LIABILITY
Materials sent are accepted on the basis that their value is the retail cost of the material and any responsibility of Living CBT/MCCBT Ltd. from whatever cause, is limited to the replacement of the material.

8. AMENDMENTS
Living CBT/MCCBT Ltd. reserves the right to alter or amend these terms and conditions of business generally or for any particular class of products or customers.

9. LEGAL CONSTRUCTION
(a) The placing of an order with Living CBT/MCCBT Ltd. shall amount to an acceptance of these terms and conditions.

(b) These terms and conditions and the contract of which this document forms part shall in all respects be construed and accordance with English Law.
